§1 GENERAL PROVISIONS

  1. The online store LumiPyramids, operating at: https://lumipyramids.com/, is run by:

  1. These Terms and Conditions define the rules for making purchases in the LumiPyramids online store, in particular the rules and procedure for concluding distance sales contracts via the Store, as well as the complaint procedure and the Consumer’s right to withdraw from the contract.

  2. With regard to services provided electronically, these Terms and Conditions constitute the regulations referred to in Article 9 of the Act of 18 July 2002 on the provision of electronic services (consolidated text: Journal of Laws of 2024, item 1513, as amended).

  3. These Terms and Conditions apply to all Store Customers. Each Customer is obliged to read the Terms and Conditions before making a purchase.

  4. Each Customer is required to comply with the Terms and Conditions. Sales are conducted on the basis of the version of the Terms and Conditions applicable at the time of placing the order.

  5. Customers may review the Terms and Conditions at any time by clicking the “Store Regulations” link on the Store’s website: https://lumipyramids.com/. The Terms and Conditions may be downloaded and printed at any time.

  6. All information contained on the Store’s website, including product descriptions and prices, does not constitute an offer within the meaning of Article 66 of the Civil Code of 23 April 1964 (consolidated text: Journal of Laws of 2024, item 1061, as amended), but constitutes an invitation to conclude a contract pursuant to Article 71 of the Civil Code. By submitting the Order Form, the Customer makes an offer to purchase and deliver the selected Product under the conditions specified in its description.


§2 DEFINITIONS

Terms and Conditions – this document setting out the rules for using the Store’s services.

Consumer – a natural person concluding a contract via the Store not directly related to their business or professional activity.

Entrepreneur with Consumer Rights – a natural person concluding a civil-law contract via the Store directly related to their business activity, where the content of the contract shows that it is not of a professional nature for that person.

Customer – a natural person (including a Consumer) who is at least 13 years old (with parental consent), a legal person, or an organizational unit with legal capacity, using the Store’s services.

Order Form – a service available on the Store’s website enabling the Customer to place an order, including adding Products to the Cart and selecting delivery and payment methods.

Cart – a Store feature displaying selected Products and enabling modification of order details.

Store – the online sales platform operated by the Seller at https://lumipyramids.com/.

Seller – Aleksandra Żyła, conducting business activity at Jaworowa 10E, 32-020 Wieliczka, Poland.

Product / Goods – a movable item being the subject of sale between the Store and the Customer.

Goods with Digital Elements – goods containing or connected with digital content or a digital service, without which the goods cannot function properly.

Digital Environment, Integration, Compatibility, Functionality, Interoperability – understood in accordance with applicable consumer protection regulations.

Contract – a distance sales contract concluded between the Customer and the Seller via the Store.


§3 ORDER PLACEMENT AND PROCESSING

  1. Use of the Store requires acceptance of these Terms and Conditions. By placing an order, the Customer accepts the Terms and Conditions.

  2. Product listing order in search results is determined automatically based on criteria such as relevance, popularity, availability, delivery time, promotions, and marketing activities. Manual highlighting may occur in promotional sections or recommended product lists.

  3. Sponsored offers and paid advertisements are clearly marked.

  4. The price stated in the order is the total gross price payable by the Customer. Delivery costs are not included and depend on the selected delivery method.

  5. Any additional costs require the Customer’s explicit consent.

  6. The Seller reserves the right to change prices, introduce new products, and conduct promotions.

  7. Promotional prices include information on the lowest price from the last 30 days.

  8. Orders may be placed 24/7 via the website or by email at: office@lumipyramids.com.

  9. Orders are placed by adding Products to the Cart, completing the Order Form, selecting delivery and payment, and confirming payment via Przelewy24.

  10. Entrepreneurs with Consumer Rights must indicate that the purchase is not of a professional nature.

  11. Order confirmation is sent by email.

  12. Order processing begins after payment confirmation.

  13. Orders are processed on business days from 9:00–17:00.

  14. The sales contract is concluded upon receipt of order acceptance confirmation.

  15. Each order includes a receipt or bill.
    The Seller benefits from VAT exemption under Article 113(1) of the VAT Act and does not issue VAT invoices.

17–19. Customer reviews are verified, authentic, not manipulated, and sponsored reviews are clearly marked.


§4 DELIVERY AND SHIPPING COSTS

  1. Delivery is carried out via parcel lockers or courier services.

  2. Orders are shipped on business days only.

  3. Standard delivery time is 5–10 business days.

  4. The Seller is not responsible for delays caused by carriers.

  5. Customers should inspect parcels upon delivery and prepare a damage report if necessary.


§5 PAYMENTS

  1. Payments are made electronically via Przelewy24.

  2. Payment is required at the time of order placement.

  3. Orders are processed after payment confirmation.

  4. Failure to pay results in no contract being concluded.

  5. Payment operator: PayPro S.A., Poznań.


§6 COMPLAINTS

  1. The Seller is liable for lack of conformity of the Product with the Contract.

  2. Liability applies for defects revealed within 2 years from delivery.

3–9. The Consumer may request repair, replacement, price reduction, or withdrawal from the contract under statutory conditions.

  1. Complaints may be submitted in writing or by email.

  2. A warranty may be granted under separate regulations.


§7 RIGHT OF WITHDRAWAL

  1. The Consumer may withdraw from the contract within 14 days without giving reasons.

2–10. Detailed withdrawal procedure, return obligations, refunds, and liability for diminished value apply.

  1. The right of withdrawal does not apply in cases listed under statutory exceptions (custom-made products, sealed goods, digital content after consent, etc.).

  2. Withdrawal rights apply to Consumers and Entrepreneurs with Consumer Rights.


§8 OUT-OF-COURT DISPUTE RESOLUTION

  1. Consumers may use mediation, consumer arbitration courts, consumer ombudsmen, or the EU ODR platform.

  2. This section does not apply to Entrepreneurs with Consumer Rights.


§9 PERSONAL DATA PROTECTION

  1. Personal data is processed solely for order fulfillment.

  2. The Seller is the data controller under GDPR.

3–6. Customers have rights of access, correction, and deletion.

§10 FINAL PROVISIONS

1–9. Polish law applies. Consumer rights under mandatory law are not limited. Invalid provisions do not affect the remaining Terms and Conditions.
